These terms and conditions govern the use of letscamp.net
with respect to the creation and maintenance of directory listings.
1.2
All references to "we" and "us" forthwith in this document
refer to letscamp.net ltd (see also 21.1).
1.3
All references to "the website" forthwith in this document
refer to any and all web accessible pages at and beneath the top level domain (tld) letscamp.net at the URL https://letscamp.net/,
and any and all pages at and beneath any subdomains of the specified tld letscamp.net.
1.4
All references to
"you" and "your" forthwith in this document refer to
any advertiser that has registered a directory listing with us,
and any other person authorised by the advertiser to maintain
that directory listing via the
letscamp.net control panel (see also 3.1 below).
1.5
By advertising your park on letscamp.net you accept and are bound by these terms and conditions in full.
1.6
You must be at least 18 years of age to use the letscamp.net Park Listing Control Panel; and by using the Control Panel,
you warrant and represent to us that you are at least 18 years of age.
If you use our website or expressly agree to these terms and conditions in the course of a business or other organisational project, then by so doing you bind both:
(a)
yourself; and
(b)
the person, company or other legal entity that operates that business or organisational project, to these terms and conditions, and in these circumstances references to "you" in these terms and conditions are to both the individual user and the relevant person, company or legal entity (unless the context requires otherwise).

Registration and accounts
4.1
You must notify us in writing immediately if you become aware of any unauthorised use of your account.
4.2
You must not access the Park Listing Control Panel for any account that you do not have express permission to do so from the registered Park Listing Account Holder.
5
Park Listing Control Panel
5.1
The Park Listing Control Panel is available to all advertisers for the purpose of maintaining and updating their listing(s).
5.2
Access to the panel is
first requested via the website here. A direct link into the control panel
is then emailed out to the advertiser's registered email address. The link incorporates security credentials
that remove the requirement of entering a password.
5.3
The direct link remains valid for up to seven days, or until the log out button is clicked within the control panel.
5.4
It is the advertisers stringent responsibility to prevent unauthorised access to the Park Listing Control Panel
for their listing by way of:
(a)
protecting against unauthorised access to the email account registered to the listing.
(b)
protecting against unauthorised use of the browser where the control panel
is either open or bookmarked
(without having logged out).
(b)
making the link available to unauthorised persons by any means, including, but not limited to,
sending, sharing, or forwarding the link by email, messaging services, or social media.

Editing, suspension, and permanent removal of listings by letscamp.net
6.1
We may at any time, at our sole discretion,
and without notice or explanation to the advertiser or any third party,
carry out any of the following actions with respect to any listing:
(a)
Add, update or remove any listing detail,
option or photo;
(b)
Suspend the listing from letscamp.net;
(c)
Permanently remove the listing from letscamp.net.
6.2
In the case that we elect to remove a listing from letscamp.net
due to a breach of these terms and conditions, and where the advertiser is not covered
by the new listing money back pledge detailed under 8.2 below,
no part of any monies paid to us previously by the advertiser will be reimbursed.
6.3
In the unlikely event we permanently remove a listing where no clear breach of
these terms and conditions has occurred, we will refund the most recent subscription payment
on a pro rata basis refund according to the number of full months remaining under that subscription
on the day the listing is removed.
7
Request to remove a listing by the Park Listing Account Holder
7.1
You have the unconditional right to instruct us to remove your
listing from letscamp.net at any point. This will be effected within 72 hours
from the receipt of such an instruction to remove.
You will only be entitled to a refund of any subscription fees paid if you ask us to remove your listing within
168 hours (seven days) of that listing first appearing on letscamp.net.

New listing creation
8.1
By clicking to proceed at the stage where contact and park details are first submitted
here, you thereby:
(a)
authorise us to contact you by telephone or email
towards the purpose of building your new listing;
(b)
authorise us to utilise photos and text from any website domains you provide on the form;
(c)
indicate you are authorised by the website & park owners to grant the permissions detailed in 8.1(a) and 8.1(b) above;
8.2
Until the end of the 14th full day after a new listing has first become available on the website,
or equally, on renewal of the annual subscription, you are free to tell us that you have changed your mind.
We will then without quibble refund the subscription fee paid,
cancel your subscription, and remove your listing from the website.
Following these 14 day grace periods, subscription fees become entirely non-returnable.
9
Renewal of an annual subscription
9.1
As your annual renewal date approaches, we will let you know 28 days, 14 days, and 7 days in advance by
email that the renewal of your
subscription is due.
9.2
You are under no obligation, financial or otherwise, to renew current subscriptions, or to reinstate lapsed subscriptions.
9.3
When a subscription has not renewed past the renewal date for any reason, we will let you know.
From that point onwards, your listing page will not be affected, however,
your listing will not be returned within search results on website, which will
very significantly reduce the exposure of your listing to website users.
10
Prohibited directory submissions
10.1
Without prejudice to our other rights under these terms and conditions, we reserve the right to
reject or delete submissions that breach these terms and conditions.
10.2
Any content that is not suitable for the viewing of children; contains adult nudity;
contains expletives or vulgar language; or that is otherwise deemed by us, at our sole discretion,
as potentially offensive to discerning users of the website will place the advertiser in breach of these
terms and conditions, and the listing will be permanently removed from the website.
10.3
If we reject or delete a submission due to breach of these terms and conditions, no part of any subscription fees
paid in association with the listing will be refunded.
11
Your content: licence
11.1
In these terms and conditions, "your content" means all works and materials (including without limitation text, graphics, images, audio material, video material, audio-visual material) that you submit to us or our website for storage or publication on, processing by, or transmission via, our website.
11.2
In the interests of maintaining the quality of listings on letscamp.net,
we reserve the unconditional right to modify or add content to your listing on your behalf without prior or subsequent notice.
This content may include text and photos derived from the park website entered for your listing,
and information found on social media and other websites under the control of the park operator.
11.3
You grant us a worldwide royalty-free licence to publish your content on the letscamp.net website.
11.4
You have the capacity to edit all of the content
associated with your listing via the letscamp.net Park Listing Control Panel.
11.5
Within the first 14 days of a new listing appearing on letscamp.net, we will be happy to update any of the
listing details available to you within the listing control panel on your behalf.
Beyond the first 14 day period however, the responsibility
for applying updates to your listing resting solely with you, via your listing control panel.
11.6
You hereby waive all your moral rights in your content to the maximum extent permitted by applicable law; and you warrant and represent that all other moral rights in your content have been waived to the maximum extent permitted by applicable law.
12
Limitations and exclusions of liability
12.1
Nothing in these terms and conditions will:
(a)
limit or exclude any liability for death or personal injury resulting from negligence;
(b)
limit or exclude any liability for fraud or fraudulent misrepresentation;
(c)
limit any liabilities in any way that is not permitted under applicable law; or
(d)
exclude any liabilities that may not be excluded under applicable law.
12.2
The limitations and exclusions of liability set out in this Section 12 and elsewhere in these terms and conditions:
(a)
are subject to Section 12.1; and
(b)
govern all liabilities arising under these terms and conditions or relating to the subject matter of these terms and conditions, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty.
12.3
We will not be liable for any loss or damage of any nature.
12.4
We will not be liable to you in respect of any business losses, including (without limitation) loss of or damage to profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities or goodwill.
12.5
We will not be liable to you in respect of any loss or corruption of any data, database or software.
12.6
We will not be liable to you in respect of any special, indirect or consequential loss or damage.
12.7
You accept that we have an interest in limiting the personal liability of our officers and employees and, having regard to that interest, you acknowledge that we are a limited liability entity; you agree that you will not bring any claim personally against our officers or employees in respect of any losses you suffer in connection with the website or these terms and conditions (this will not, of course, limit or exclude the liability of the limited liability entity itself for the acts and omissions of our officers and employees).
12.8
Our aggregate liability to you in respect of any contract to provide services to you under these terms and conditions shall not exceed the greater of:
(a)
the total amount paid and payable to us under the contract.
13
Indemnity
13.1
You hereby indemnify us, and undertake to keep us indemnified, against any and all losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by us to a third party in settlement of a claim or dispute) incurred or suffered by us and arising directly or indirectly out of:
(a)
any breach by you of any provision of these terms and conditions; or
(b)
your use of our website.

Variation
14.1
We may revise these terms and conditions from time to time.
14.2
The revised terms and conditions will apply to the use of our website
from the date of their publication on the website, and you hereby waive any right you may
otherwise have to be notified of, or to consent to, revisions of the terms and conditions.
15
Assignment
15.1
You hereby agree that we may assign, transfer, sub-contract or otherwise deal with our rights and/or obligations under these terms and conditions.
15.2
You may not without our prior written consent assign, transfer, sub-contract or otherwise deal with any of your rights and/or obligations under these terms and conditions.
16
Severability
16.1
If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect.
16.2
If any unlawful and/or unenforceable provision of these terms and conditions would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

Third-party rights
17.1
These terms and conditions are for our benefit and your benefit and are not intended to benefit or be enforceable by any third party.
17.2
The exercise of the parties' rights under these terms and conditions is not subject to the consent of any third party.
18
Law and jurisdiction
18.1
These terms and conditions shall be governed by and construed in accordance with English law.
18.2
Any disputes relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of England.
20
Statutory and regulatory disclosures
19.1
We will not file a copy of these terms and conditions specifically in relation to each user or customer and, if we update these terms and conditions, the version to which you originally agreed will no longer be available on our website.
19.2
These terms and conditions are available in the English language only.
